Terms of Use — An Owl's World

1. Agreement

An Owl’s World (the “game”) and owlworld.owlmedia.games (the “website”) are provided by Owl Media and Design, LLC (“we”, “us”). By downloading, installing, or playing the game, or using the website, you agree to these Terms of Use and to our Privacy Policy. If you don’t agree, please don’t use them.

If you’re under the age of majority where you live, a parent or guardian must review and agree to these terms for you. Parents and guardians are responsible for their child’s use of the game, including any purchases.

2. Your account

The game creates a guest account for you automatically. You can link Sign in with Apple to keep your progress across devices. You’re responsible for activity on your device and account. If you haven’t linked Sign in with Apple, your progress is tied to your device, and it can’t be recovered if you delete the app or lose the device.

3. Using the game

We give you a personal, non-exclusive, non-transferable, revocable license to use the game on Apple devices you own or control, for your own non-commercial entertainment. This license is subject to these terms and to Apple’s Licensed Application End User License Agreement. If the two conflict, these terms apply to the extent the law allows.

Apple isn’t a party to these terms and isn’t responsible for the game, its content, maintenance, or support, or for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

4. Fireflies and in-game items

Fireflies are earned by playing and can be spent on lives, characters, and power-ups. Fireflies and in-game items:

Can’t be bought with real money, and have no cash or real-world value
Can’t be sold, traded, transferred, or exchanged outside the game
Are licensed to you for use in the game, not owned by you

We may change prices, balance, or how items work to keep the game fun and fair. Your items are removed if you delete your account or if we close it under section 9.

5. Owl World Pro

Owl World Pro is an optional one-time purchase that unlocks unlimited lives and every character. It doesn’t renew. The price is shown in the App Store before you buy. Apple processes the payment under its own terms, and refund requests go to Apple at reportaproblem.apple.com.

You can restore Pro on another device signed in to the same Apple account by using Restore purchases in the game. If Apple refunds or reverses a purchase, Pro benefits are removed. Pro doesn’t include power-ups, which are bought with fireflies.

6. Fair play

You agree not to:

Cheat, or use bots, scripts, modified clients, or other tools to play for you or change results
Exploit bugs or glitches to gain fireflies, lives, or items. Please report them to us instead.
Copy, modify, decompile, or reverse engineer the game, except where the law allows it
Access or tamper with our servers, other players’ accounts, or the game’s network traffic
Overload, disrupt, or interfere with the game or the website
Use the game for any unlawful purpose

If we find cheating or abuse, we may remove fireflies, items, or records gained that way, or suspend or close the account involved.

7. The online service

The game needs an internet connection to start runs, use the shop, and save progress. We work to keep it running, but we can’t promise it will always be available or free of errors. We may update, change, or stop offering any part of the game, including features, levels, and items. If we plan to shut down the online service for good, we’ll try to give reasonable notice in the game or on this website.

8. Ownership

The game and the website, including their artwork, characters, levels, music, sound, and code, belong to Owl Media and Design, LLC or our licensors and are protected by intellectual property laws. Some parts, such as the Press Start 2P font, are used under open-source licenses. Apart from the license in section 3, these terms don’t give you any rights to our content, names, or logos.

If you send us ideas or feedback, we may use them without any obligation to you.

9. Ending these terms

You can stop playing at any time and delete your account in the game. We may suspend or close your account if you seriously or repeatedly break these terms, or if the law requires it. When these terms end, your license to use the game ends too. Sections 4, 8, 10, 11, and 12 continue to apply.

10. Disclaimers

The game and the website are provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t promise that the game will be uninterrupted, error-free, or that progress will never be lost.

If the game doesn’t conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, to the extent its policies allow. Apple has no other warranty obligation for the game.

11. Limitation of liability

To the fullest extent the law allows, Owl Media and Design, LLC won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, progress, or in-game items, arising from your use of the game or the website. Our total liability for any claim relating to the game or the website is limited to the greater of the amount you paid for Owl World Pro in the twelve months before the claim, or US$50.

Some places don’t allow these limits, so they may not all apply to you. Nothing in these terms limits rights you have under consumer protection laws that can’t be waived.

12. Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law rules. Any dispute that can’t be resolved informally will be heard in the state or federal courts located in Texas, and you and we consent to their jurisdiction. If you live outside the United States, you may also have the right to bring a claim in your local courts under your local consumer laws.

Before bringing a claim, please email us so we can try to resolve it together.

13. Changes to these terms

We may update these terms from time to time. We’ll post the new version here and update the effective date. If a change is significant, we’ll let you know in the game or on this website. If you keep playing after a change takes effect, you accept the updated terms.

If any part of these terms can’t be enforced, the rest still applies.
